Regulations - DEFINITIONS

“Company” means Millstream Mooring Ltd, including its associated companies and any of its servants or agents.

“Moorings” refers to the pontoons and all associated land and buildings occupied by or under the control of the Company including docks, slipways, pontoons, walkways, roads and car parks. The Glass balustrade and gate denote the entrance to the hard standing mooring and floating pontoon areas.

“Regulations” mean those regulations, Policies, general conditions, hazards, restrictions, notices and other communications (if any) made by the Company as may be amended from time to time which the Company in its absolute discretion, considers necessary to enable the Company or those using the Moorings to comply with applicable legal requirements or for the safety or security or good management of the Moorings.

“Vessel” means the craft, boat, barge or other watercraft as identified in the Licence.

“Owner” means the person or organisation identified in the Licence and as legally owning the Vessel to which that licence applies.

“Guests” means any person(s) granted access to the Moorings by the Company or the Owner for whatsoever purpose.

"Host" means either the Company or Owner of invited Guests to the Moorings

"Trespasser" means any person entering the Moorings that is not accompanied by a Host or has been banned by the Company.

• Hosts are responsible for the safety of their Guests while at the Moorings and are required to brief their Guests on the Company regulations and safety ahead of accessing the Moorings. By entering the Moorings Guests acknowledge the Company regulations and safety requirements and agree to be bound by these. To assist, Guests are advised to read the "Guest regulations" and "What to do in an emergency" sections of the Millstream moorings website - millstreammoorings.co.uk.

General Notices/Safety

• All persons are required to act in a responsible manner at all times while at the Moorings. This means being in a fit state physically and mentally to use the moorings competently and safely.

• There are three bollards placed along the floating pontoon which provide low level lighting. In addition Solar lighting has been installed to also provide a low level light during the hours of darkness. Motion sensors are set to trigger when movement is detected in the vicinity of the lights, activating a burst of bright light for 20 seconds, which is repeated upon continued movement. Lighting is installed to allow safe passage at the Moorings during the hours of darkness; between sunset and dawn. In the event that the lighting does not operate as described, due to powercut, solar battery depletion, lighting failure, theft or only a weaker light is provided etc. All persons accessing the Moorings between sunset and dawn are recommended to bring their own or supplementary lighting.

• All persons are prohibited from accessing vessels on the Bridge Eyot side of the moorings when the river is on red boards "Caution strong stream"/ in flood condition.

• It is recommended that no one enter the hard standing or floating pontoon areas of the Mooring when the river is on red boards "Caution strong stream"/ in flood condition and must take extra care when the river is on amber boards "Caution Stream Increasing" or "Caution stream decreasing" as indicated by the EA.

• It is recommended that no one enter the hard standing area of the Mooring when these are flooded or icy.

• It is recommended that lifejackets and other safety equipment is worn by all persons accessing the hard standing or floating pontoon areas.

• Owners are asked to report any hazards or safety concerns to the Company in person or by email - millstreammoorings_enquiries@protonmail.com.

• No persons are permitted to swim in the vicinity of the Moorings or to launch canoes, rowing boats, paddleboards or other such vessels or equipment from the Moorings, due to the danger posed by manoeuvring powered vessels. Only the Company tender use to access the Bridge Eyot moorings is exempt from the above.

• All persons using the Moorings are advised to take time to consider what they would do the event of an emergency including locating and understanding how to use lifesaving equipment and calling the emergency services - See "What to do in an emergency while at the Moorings" at millstreammoorings.co.uk.

Guest Regulations

• Guests are the responsibility of their Host and must be accompanied by their Host at all times.

• Guests are required to be briefed by their Host on all Company regulation and Safety matters before entry to the Moorings.

• By entering the Moorings Guests acknowledge the Company regulations and Safety requirements and agree to be bound by these.

• Guests must not enter the hard standing or floating pontoon areas of the Mooring when the river is on red boards "Caution strong stream"/ in flood condition and must take extra care when the river is on amber boards "Caution Stream Increasing" or "Caution stream decreasing" as indicated by the EA. The Owner is responsible for informing Guests of river conditions although these can be found on the EA pages.

• Guests should ensure that all security gates used for the purpose of accessing or proceeding through the Moorings are closed securely after use.

• Should Guests be given or become aware of any of the security gates codes, they are required to keep these secret and never to use them to enter the Moorings other than when accompanied by a Host.

• All Guests are required to wear suitable non-slip footwear when accessing the hard standing mooring and floating pontoon areas .

• It is recommended that Guests wear lifejackets and any other safety equipment deemed relevant or necessary by them or the Owner when accessing the hard standing or floating pontoon areas of the Moorings.

• Children and animals must wear suitable safety equipment and always kept under close supervision.

• Guests are required to maintain awareness of the river's edge and the cleats that are located here, for the securing of vessels to the Moorings. Guests should maintain a safe distance from the river's edge (as much as reasonably possible given the situation) at all times other than when embarking and disembarking.

• Guest should pay particular attention when using the ramp leading from the hard standing area to the floating pontoons. Extra care should be taken when accessing this part of the Moorings due to it being narrower, sloped and subject to some movement (it will move up and down with the river). Handrails are installed to assist passage on the ramp. For clarity, the ramp is secured in a manner that allows it to move up and down in response to the river level and due to this, extra care must be taken when proceeding along it. This is particularly so when the river is indicated as being in anything other than Green boards by the EA.

• Guests are required to act in a responsible manner at all times while at the Moorings. This means being in a fit state physically and mentally to use the moorings competently and safely.

• Owners are responsible for reporting any accident or injury, sustained by them or their Guests while using the Moorings. All accidents must be reported within 24 hours of taking place.

• Owners and Guests are not permitted to swim in the vicinity of the Moorings or to launch canoes, rowing boats, paddleboards or other such vessels or equipment from the Moorings, due to the danger posed by manoeuvring powered vessels. Only the Company tender use to access the Bridge Eyot moorings is exempt from the above.

• Any Guest that does not accept to be bound by the Company regulations and Safety requirements must not enter the Moorings.
